When a start-up or small business does well, it often means that it can begin to add talent and alleviate at least some of the labor burden on its founders.  But, failure to do so carefully is fraught with legal risk.  This session will discuss the differences between an independent contractor and an employee, how to conduct an interview that doesn’t run afoul of the law, and employee discipline and performance management.  Finally, we will cover ways to use the tools and concepts provided by federal, state, and local employment laws to help you build your workplace culture in a way that represents you and enables you to continue to grow. 

Christopher T. Cognato is an associate in the Labor and Employment Group at Ballard Spahr LLP.  He advises public and private employers on a range of labor and employment issues, including compliance with federal, state, and local law.  He frequently helps clients large and small to develop employment policies, including those related to hiring, firing, disciplinary practices, employee leave, and reasonable accommodations.  He also assists clients by conducting internal investigations, reviewing and draft employment contracts and separation agreements, conducting wage and hour audits, and providing supervisor training on a range of legal and talent-management issues.
